Welcome to SEA FUN FL. These Terms & Conditions (“Terms”) govern your access to and use of seafun.shop (the “Site”) and your purchase of products from SEA FUN FL (“SEA FUN,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Us

SEA FUN FL is a U.S. retailer of underwater camera housings, dome and flat ports, and underwater photography accessories, located at 24 Carlisle Drive, Miami Springs, FL 33166, United States. Contact: [email protected], (786) 927-7131.

2. Eligibility

You must be at least 18 years old (or the age of majority in your state) to place an order. By ordering, you represent that you meet this requirement and that all information you provide is accurate and complete.

3. Products, Descriptions & Compatibility

We work hard to describe every product accurately, including depth ratings, camera compatibility, and port/lens fitment. However:

Product images are illustrative; colors may vary slightly due to display differences.
Camera and lens compatibility is your responsibility to verify before purchase. Consult the product page, our port compatibility chart, and — when in doubt — email [email protected]; we gladly confirm fitment before you order.
Manufacturers occasionally revise designs; where a specification matters to you, ask us to confirm the current version.
Obvious errors in descriptions or specifications may be corrected at any time; if a correction materially affects an order you already placed, we will contact you with the option to confirm or cancel with a full refund.

4. Safety, Depth Ratings & Proper Use — Important

Underwater housings are precision sealing instruments. Read the manufacturer’s manual before first use. By purchasing, you acknowledge and agree that:

Depth ratings (e.g., 60 m / 195 ft) apply only to a correctly assembled, correctly sealed housing in good condition, and must never be exceeded.
O-rings must be inspected, cleaned, lightly lubricated with the correct silicone grease, and correctly seated before every dive; O-rings are consumable parts that require periodic replacement.
A pre-dive leak test without the camera installed (pool, bathtub, or shallow water), and the use of a vacuum leak-check system where supported, are strongly recommended before every trip.
The housing warranty does not cover the camera, lens, or other contents of the housing. We recommend insuring valuable camera equipment separately.
Scuba diving, freediving, and other water activities carry inherent risks; our products are accessories for such activities and are not life-safety equipment. Always dive within your training and certification limits.

5. Orders & Order Acceptance

Your order is an offer to buy. We accept it when we send the shipping confirmation email. We may refuse or cancel any order — for example, for suspected fraud, pricing or stock errors, or inability to verify order information — in which case any amount charged is refunded in full. We may also limit quantities per customer.

The ordering process works as follows: (a) you add products to your cart and proceed to checkout; (b) you review your order, shipping address and totals — including taxes and any shipping charge — before payment; (c) you submit the order and receive an order confirmation email acknowledging receipt; (d) we perform stock and fraud checks; and (e) our shipping confirmation email constitutes acceptance and forms the contract of sale for the items shipped. If any item cannot be supplied, we will contact you before dispatch with the options described in our Shipping Policy (wait, substitute, or refund).

You can request changes or cancellation at no cost any time before dispatch by emailing [email protected].

6. Prices & Payment

All prices are in U.S. dollars and exclude sales tax, which is calculated at checkout where applicable.
Promotional prices and discount codes are valid only during their stated period and cannot be applied retroactively.
Payment is collected at the time of order through our secure third-party payment processors. We never store your full card number.
If a price is obviously erroneous (e.g., a $1,200 housing listed at $12), we may cancel the order and refund you; we will offer you the option to repurchase at the correct price.

7. Shipping & Delivery

Shipping is governed by our Shipping Policy, which forms part of these Terms. In short: we currently ship within the United States only; standard shipping is free on orders of $100 or more and $9.95 otherwise; risk of loss passes to you upon delivery to the address you provided.

8. Returns, Refunds & Warranty

Returns and refunds are governed by our Returns & Exchanges Policy, which forms part of these Terms — including the 30-day return window, condition requirements, and the scope of the 1-year manufacturer warranty (and what it does not cover, such as flooding caused by improper sealing). Nothing in these Terms limits any non-waivable statutory rights you may have under applicable law.

9. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at [email protected] of any unauthorized use. We may suspend or terminate accounts that violate these Terms or are used for fraudulent activity.

10. Intellectual Property

All content on the Site — text, product descriptions, photographs, graphics, logos, and layout — is owned by SEA FUN FL or its licensors (including product manufacturers) and is protected by copyright and trademark law. You may browse and print pages for personal shopping use; any other reproduction, distribution, or commercial use requires our prior written consent. All manufacturer trademarks (including camera brand names) are the property of their respective owners and are used solely to describe product compatibility.

11. Acceptable Use

You agree not to: interfere with the Site’s operation or security; attempt to access other customers’ data; use automated tools to scrape the Site; post unlawful, misleading, or infringing content (including in product reviews); or use the Site for any unlawful purpose.

12. Reviews & Submissions

If you submit a product review, photo, or other content, you grant us a non-exclusive, royalty-free, perpetual license to use, display, and reproduce it in connection with our store and marketing, with attribution to your provided display name. You represent that your submissions are your own and do not infringe third-party rights. We may moderate or remove reviews that violate Section 11.

13. Disclaimer of Warranties (Site)

The Site itself is provided “as is” and “as available.” While we strive for accuracy and uptime, we do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. This section concerns the website; product warranties are described in Section 8.

14. Limitation of Liability

To the maximum extent permitted by law: (a) our total liability arising out of or relating to any order shall not exceed the amount you paid for that order; and (b) we shall not be liable for indirect, incidental, special, consequential, or punitive damages — including loss of camera equipment placed inside a housing, lost profits, lost data (including images), or the cost of substitute goods — even if advised of the possibility. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms excludes liability that cannot be excluded by law, including for gross negligence, willful misconduct, or personal injury caused by our negligence.

15. Indemnification

You agree to indemnify and hold SEA FUN FL harmless from claims arising out of your misuse of the Site, violation of these Terms, or infringement of any third-party rights by content you submit.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Before filing any claim, you agree to contact us at [email protected] so we can try to resolve the matter informally within 30 days — most issues are resolved this way. Any dispute that cannot be resolved informally shall be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction. You and SEA FUN FL each waive any right to a jury trial to the extent permitted by law. Nothing in this section prevents either party from bringing an individual claim in small-claims court.

17. Force Majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, hurricanes and severe weather, carrier disruptions, strikes, utility or network outages, acts of government, or supplier failures. If such an event delays an order by more than 14 days, you may cancel the affected order for a full refund.

18. Changes to These Terms

We may revise these Terms from time to time. The version posted at the time you place an order applies to that order. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

19. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, together with the Shipping, Returns, and Privacy policies, constitute the entire agreement between you and SEA FUN FL regarding the Site. Our failure to enforce any provision is not a waiver. You may not assign your rights under these Terms; we may assign ours in connection with a business transfer.
